Except as required by law, the total liability of XoVintage Parties for any claim arising out of or related to these Terms or your use of our Services will not exceed the greater of one thousand U.S. dollars ($1,000) or the total amount paid by you to XoVintage, LLC for purchases made in the twelve (12) months preceding the claim.
These limitations do not apply to damages arising from intentional misconduct, fraud, or gross negligence by XoVintage, LLC or where liability cannot otherwise be excluded under applicable law.
Some jurisdictions do not allow limitations of liability; in such cases, these limitations will apply to the fullest extent permitted.
General Conditions
We reserve the right to refuse Service to anyone for any reason at any time.
You agree to provide current, complete, and accurate purchase and account information for all transactions. If incorrect address information causes delivery issues, XoVintage, LLC is not responsible for resulting costs.
Any advice or information provided by XoVintage, LLC via customer support is offered in good faith and should not be considered legally binding.
Age Restrictions: This website and the products offered are intended for purchase by individuals who are at least eighteen (18) years of age, or the age of majority in their jurisdiction, whichever is higher. By placing an order, you represent and warrant that you have the legal capacity to enter into a binding contract and are authorized to use the payment method provided. Purchases made by minors without valid parental or legal guardian authorization are not permitted. Pricing Errors: In the event of a pricing, typographical, or listing error, XoVintage, LLC reserves the right to cancel affected orders, even after an order confirmation has been sent or payment has been processed.

XoVintage, LLC disclaims liability for minor discrepancies between images and received items or for good-faith use of third-party imagery.
All items are evaluated in good faith for authenticity and quality before being offered for sale. XoVintage, LLC uses its experience, research, and reputable industry resources to assess each item. These evaluations represent honest opinions based on available information and are not professional guarantees. For most items, XoVintage, LLC purchases third-party authentication certificates from independent services such as LegitApp or AuthenticDetective. These certificates reflect the independent opinions of those services and are not issued or endorsed by the original brands.
Because authentication involves expert judgment and may vary between evaluators, XoVintage, LLC is not liable for differing opinions or reliance on third-party assessments. If an item is later proven inauthentic through a recognized independent authentication authority, XoVintage, LLC will provide a full refund of the original purchase price, including standard shipping costs and customs fees.
The brands featured on this website are not involved in the authentication or sale of items and do not assume responsibility for any products purchased from or through XoVintage, LLC. The brands listed are not partners or affiliates of XoVintage, LLC in any capacity.
Shipping Policy
Shipping availability and rates vary by location. Customs fees, duties, and taxes are the responsibility of the buyer. XoVintage, LLC is not liable for customs delays or additional charges. Items returned due to customs issues, incorrect addresses, or buyer error require additional postage for reshipment. XoVintage, LLC is not responsible for loss or damage during transit; claims must be filed directly with the carrier.
Brand Affiliation Disclaimer
XoVintage, LLC is an independent reseller of pre-owned goods and is not affiliated with, endorsed by, or an authorized retailer of any featured brands. All trademarks, brand names, and logos remain the property of their respective owners and are used solely for descriptive purposes. By purchasing from this store, you acknowledge that no relationship exists between XoVintage, LLC and any featured brand.
Condition & Return Policy
Due to the pre-loved and vintage nature of our products, all items are sold “as-is.”
Once you have agreed on the final offer to purchase, the transaction is complete. All sales are final. No refunds, returns, or credits are permitted.
In rare instances, at our sole discretion, we may make exceptions to this policy to best support our customers. Any such exception will be considered on a case-by-case basis and does not constitute a change in our general policy or a guarantee of future accommodation.
Payment Disputes
By completing a purchase, you agree not to initiate a chargeback or payment dispute without first contacting XoVintage, LLC to attempt resolution. Fraudulent or abusive chargebacks will be reported to payment processors and may result in legal action and termination of customer access.
Limitation on Claims
Any claim or cause of action arising out of or related to a purchase or your use of this website must be filed within 3 months after the claim arose. After that period, the claim is permanently barred.
Disclaimer of Warranties
We do not guarantee that your use of our Service will be uninterrupted or error-free. You expressly agree that your use of the Service is at your sole risk.

Dispute Resolution and Arbitration
Before taking any formal action, you agree to contact XoVintage, LLC at hello@xovintage.shop to try to resolve any concern or dispute in good faith. Most issues can be quickly resolved this way.
If a matter cannot be resolved informally within sixty (60) days, both parties agree to settle the dispute through confidential binding arbitration instead of in court. The arbitration will be conducted by a single neutral arbitrator under the Consumer Arbitration Rules of the American Arbitration Association (AAA) in Los Angeles County, California, or by video conference if more convenient.
By agreeing to these Terms, you and XoVintage, LLC waive the right to a jury trial or to participate in a class action or representative proceeding. Each dispute must be handled individually.
Either party may bring a claim in small claims court if it qualifies under that court’s rules. Requests for temporary injunctive relief may also be made in any court of competent jurisdiction without waiving this arbitration agreement.
If any part of this section is found unenforceable, the remainder will still apply, and any claims that must proceed in court will be heard only in Los Angeles County, California, under California law.
User Content and Non-Confidentiality
When customers submit photos, messages, reviews, or other materials (“Postings”) to XoVintage, LLC through our website, email, or social media, you understand and agree that such Postings may be publicly visible and shared on our online platforms.
Your Postings will be treated as non-confidential, even if labeled “confidential,” “private,” or “proprietary.” XoVintage, LLC assumes no obligation of confidentiality, compensation, or credit with respect to any Posting.
By submitting content, you grant XoVintage, LLC a worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display such materials across our website, social media, and marketing channels. You confirm that you own or have the necessary rights to any materials you provide and that your submission does not violate third-party rights, including copyrights, trademarks, or privacy rights.
Confidentiality of Private Communications
All private communications between XoVintage, LLC and its customers, including direct messages, emails, and text conversations, are considered confidential correspondence. Customers may not publicly share, post, or distribute screenshots or transcripts of such communications without the prior written consent of XoVintage, LLC. This does not limit a customer’s right to share honest reviews or personal experiences, provided no private messages or identifying correspondence are disclosed.
Severability and Waiver: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions. Failure by XoVintage, LLC to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless XoVintage, LLC, its officers, directors, employees, agents, affiliates, and service providers from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of our website or Services, your breach of these Terms, or your violation of any law or third-party right. XoVintage, LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.
Changes to Terms: XoVintage, LLC reserves the right to modify these Terms at any time. Updated Terms will be posted on this website with a revised “Last updated” date. Continued use of the site after such changes constitutes acceptance of the revised Terms.
Force Majeure
XoVintage, LLC shall not be liable or deemed in default for any delay or failure in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, wars, terrorism, civil unrest, labor strikes, pandemics, transportation interruptions, or government restrictions. If such an event temporarily prevents shipment or fulfillment, we will notify you as soon as possible and offer either to defer delivery or issue a refund in accordance with our policies.

These Terms and any related agreements shall be governed by and construed in accordance with the laws of the State of California, United States.
